II. Rozsah a definície
(1) Tieto všeobecné zmluvné podmienky sa vzťahujú na všetky vami zadané objednávky produktov prostredníctvom webovej stránky https://shop.cybex-online.com/ a na všetky ostatné právne transakcie uzavreté medzi vami a nami, spoločnosťou CYBEX Retail GmbH, pomocou tejto webovej stránky, ktorá sa ďalej označuje ako „online obchod CYBEX“.
(2) Náš online obchod CYBEX je zameraný výlučne na spotrebiteľov.
(3) Zadaním objednávky v našom online obchode CYBEX beriete na vedomie a súhlasíte s tým, že máte zákonný vek požadovaný vo vašej krajine na uzatváranie záväzných zmlúv.
III. Uzavretie kúpnej zmluvy
1. Objednávanie a kroky na uzavretie zmluvy
(1) Produkty zobrazené v online obchode CYBEX ešte nepredstavujú záväznú ponuku na uzatvorenie kúpnej zmluvy. Je to len pozvánka na predloženie záväznej nákupnej ponuky.
(2) Pred zadaním prvej objednávky sa môžete zaregistrovať ako nový zákazník. Môžete sa tiež zaregistrovať neskôr. Zadanie objednávky je možné aj bez registrácie, t. j. ako hosť.
Povinné údaje požadované v priebehu procesu registrácie alebo objednávania musia byť poskytnuté pravdivo. Ak poskytnete ďalšie dobrovoľné informácie, všetky takéto informácie musia byť tiež pravdivé.
(3) Aktivácia tlačidla „Pridať do košíka“ vám umožňuje bez povinnosti vložiť požadovaný tovar do virtuálneho nákupného košíka. Obsah nákupného košíka si môžete pozrieť aktiváciou tlačidla nákupného košíka. Môžete tiež zmeniť počet položiek vložených do nákupného košíka a odstrániť položky z košíka.
(4) Po aktivácii tlačidla „Pokračovať do pokladne“ vás požiadame, aby ste zadali svoje osobné údaje a vybrali spôsoby platby a prepravy, pokiaľ ste počas registrácie nezadali niektoré z týchto informácií. 2. Prijatie, potvrdenie zmluvy a iné zmluvné požiadavky
(1) Po prijatí vašej objednávky vám bez zbytočného odkladu pošleme e-mail s potvrdením prijatia vašej objednávky a s uvedením jej podrobností (potvrdenie o prijatí). Toto potvrdenie o prijatí ešte nepredstavuje prijatie vašej nákupnej ponuky.
(2) Hneď ako tovar odovzdáme dopravnej spoločnosti (potvrdenie o preprave), e-mailom vám oznámime, že ste objednaný tovar odoslali. Pokiaľ výslovne neuvedieme inak, potvrdenie o doručení tiež predstavuje naše záväzné prijatie vašej ponuky na nákup.
3. Informácie o vašom práve na odvolanie súhlasu
(1) Ako spotrebiteľ máte nasledujúce právo na odvolanie.

Dôsledky odvolania

Pokiaľ s vami nie je výslovne dohodnuté inak, použijeme rovnaké platobné prostriedky, aké ste použili pri pôvodnej transakcii na akúkoľvek takúto refundáciu. V žiadnom prípade vám nebude účtovaný žiadny poplatok.
Vrátenie peňazí môžeme odmietnuť, kým nedostaneme vrátený tovar alebo kým neposkytnete dôkaz o tom, že ste tovar vrátili, podľa toho, čo nastane skôr.

Za akúkoľvek stratu hodnoty tovaru budete zodpovední iba v prípade, že je takáto strata hodnoty spôsobená manipuláciou s tovarom, ktorý nie je potrebný na testovanie povahy, vlastností a fungovania tovaru.

(2) Vylúčenie práva na odvolanie:
Právo na odvolanie neexistuje pre nasledujúce zmluvy, pokiaľ sa zmluvné strany nedohodli inak:
– zmluvy o dodávke tovaru, ktorý nie je prefabrikovaný a ktorého výroba sa riadi individuálnym výberom alebo určením spotrebiteľa alebo ktoré sú jasne prispôsobené individuálnym potrebám spotrebiteľa;
– zmluvy o dodávke uzavretého tovaru, ktorý nie je vhodný na vrátenie z dôvodu ochrany zdravia alebo hygieny, ak bola jeho pečať po dodaní odstránená.

4. Ďalšie dobrovoľné právo na vrátenie tovaru
(1) Okrem zákonného práva na odvolanie vám udeľujeme dobrovoľné právo na vrátenie celkovo 30 dní. Lehota začína plynúť dňom po prijatí tovaru.
V rámci tejto 30-dňovej lehoty môžete zmluvu zrušiť (dokonca aj po 14-dňovej lehote zrušenia) vrátením tovaru. To sa nevzťahuje na tovar, ktorý je vylúčený zo zákonného práva na odvolanie.
Aby ste mohli uplatniť svoje právo na vrátenie tovaru, je potrebné, aby bol tovar úplný, v pôvodnom balení a v nepoužitom a nepoškodenom stave. Žiadne tesnenia na tovare sa nesmú poškodiť ani odstrániť. Termín sa považuje za dodržaný, ak tovar pošlete včas.

5. Ďalšie informácie
(1) Zmluvný text objednávok, ku ktorému máte prístup po dokončení objednávacieho procesu, uchovávame. Informácie o objednávke si môžete vytlačiť aj po odoslaní objednávky. Po potvrdení prijatia, najneskôr však pri doručení tovaru, vám poskytneme aj obsah zmluvy v textovej forme (e-mailom alebo v tlačenej podobe).
(2) Tieto všeobecné zmluvné podmienky si môžete kedykoľvek prezrieť, uložiť a vytlačiť na našej webovej lokalite online obchodu CYBEX pod hypertextovým odkazom „Zmluvné podmienky“.
(3) Zmluva bude uzatvorená a realizovaná v anglickom a slovenskom jazyku.
IV. Plnenie kúpnej zmluvy, spracovanie platieb, doručenie
1. Ceny a prepravné náklady, špeciálne ponuky, dostupnosť, obmedzenia doručenia
(1) Naše ceny zahŕňajú zákonnú daň z pridanej hodnoty, ktorá je platná v čase vašej objednávky.
(2) Za odoslanie účtujeme paušálnu sadzbu. Sadzba za štandardné doručenie v Nemecku je 7,90 EUR. Pre všetky ostatné členské štáty EÚ, do ktorých doručujeme, sa uplatňuje paušálny poplatok za prepravu vo výške 9,90 EUR.
Náklady na doručenie vám budú jasne oznámené znova aspoň na stránke s podrobnosťami o produkte (v prípade potreby prostredníctvom hypertextového odkazu).
(3) Upozorňujeme, že zvyčajne dokážeme ponúknuť špeciálne ponuky len v obmedzenom časovom období. Tovar zobrazený v online obchode CYBEX tiež podlieha inej dostupnosti. Dostupnosť produktu sa môže líšiť aj v závislosti od vašich špecifikácií (napríklad veľkosti alebo farby). Ak produkt nie je k dispozícii, bude to uvedené v príslušných informáciách o produkte.
Ak sa po prijatí vašej objednávky ukáže, že tovar objednaný od nás je dočasne nedostupný, oznámime vám to bez zbytočného odkladu a skontaktujeme sa s vami (napr. prostredníctvom dodatočného e-mailu). Ak tovar natrvalo nie je na sklade, nebudeme môcť prijať vašu objednávku, aby v takom prípade nevznikla žiadna zmluva.
2. Spôsoby platby a platobné podmienky
(1) Platba za tovar sa vykoná jedným z nižšie uvedených spôsobov platby. Máme však právo vylúčiť určité spôsoby platby v jednotlivých prípadoch.
Kreditná karta: pri platbe kreditnou kartou bude suma odpočítaná pri odoslaní tovaru. Prijímame karty Visa, American Express a Mastercard.
PayPal: na zaplatenie prostredníctvom online platobnej služby PayPal budete potrebovať účet PayPal. Ak vyberiete tento spôsob platby, budete presmerovaný/-á na webovú stránku PayPal na platbu. Suma bude odpočítaná po odoslaní tovaru.
Apple Pay: Apple Pay je spôsob platby, ktorý ponúka spoločnosť Apple Inc. Ak chcete používať Apple Pay, musíte aktivovať funkciu Apple Pay (napr. na vašom iPhone), identifikovať sa s vašimi prístupovými údajmi a potvrdiť platobný príkaz. Suma bude odpočítaná pri dodaní tovaru.
Darčekový poukaz: darčekové poukážky a príslušné kreditné zostatky s nimi spojené je možné uplatniť až pred dokončením procesu objednávky. Akékoľvek použitie po dokončení objednávacieho procesu nie je možné. Zostatok kreditu vo forme darčekovej poukážky nebude vyplatený v hotovosti ani nebude viazaný úrokom.
(2) Bez ohľadu na zvolený spôsob platby dostanete faktúru najneskôr spolu s doručením tovaru. Ak sa fakturačná adresa líši od dodacej adresy, faktúru pošleme poštou na fakturačnú adresu alebo e-mailom na e-mailovú adresu, ktorú ste nám poskytli.
3. Časy doručenia; preprava a prevod rizika; čiastočné dodávky; predvolené
(1) Časy doručenia uvedené v tabuľke v online obchode CYBEX sa vzťahujú na doručenia v Nemecku a považujú sa za začiatok nášho záväzného prijatia vašej ponuky.
Informácie o časoch doručenia pre doručenia do iných krajín sú tiež uvedené v tabuľke.
(2) Dodávky budú doručené na vami uvedenú adresu doručenia. Zásielky bude vykonávať vhodná prepravná spoločnosť. Riziko náhodnej straty objednaného tovaru na vás prechádza ihneď po odovzdaní tovaru vám alebo vášmu splnomocnenému zástupcovi, alebo ak ste nedodržali podmienky prijatia.

(4) Ak ste v omeškaní s platbou, vyhradzujeme si právo požiadať vás o zákonnú úrokovú závierku. Nárok na dodatočné škody spôsobené omeškaním zostáva rezervovaný.
4. Zachovanie vlastníckeho titulu; kompenzácia a udržanie
(1) Tovar zostane naším majetkom, kým nebude fakturovaná suma zaplatená v plnej výške.
(2) Nároky voči našim nárokom môžete podávať iba s protinárokmi, ktoré boli právne stanovené alebo nie sú sporné.
(3) Práva na uchovávanie sú povolené len vtedy, ak sa týkajú nárokov založených na rovnakom zmluvnom vzťahu.
5. Vaše práva týkajúce sa chýb
Ak je tovar poškodený alebo ak vykazuje inú chybu (napr. dodávka je nedokončená), máte nárok na zákonné práva podľa nemeckého práva voči nám z dôvodu chýb („záručné práva“) spolu s akoukoľvek inou ochranou podľa povinných ustanovení v štáte, v ktorom máte ako spotrebiteľ obvyklý pobyt.
6. Zodpovednosť a obmedzenie zodpovednosti
(1) Sme zodpovední voči vám bez obmedzenia v prípade úmyselného (vrátane podvodného úmyslu) alebo hrubej nedbalosti, v prípade nedbalosti alebo úmyselného zranenia na životoch, tele alebo zdraví, na základe prísľubu záruky (pokiaľ nie je stanovené inak) a na základe povinnej zodpovednosti, ako napríklad podľa nemeckého zákona o zodpovednosti za výrobky, spolu so zákonom o zodpovednosti za výrobky podľa povinných ustanovení v štáte, v ktorom máte ako spotrebiteľ obvyklé bydlisko.
(2) V prípade porušenia závažného zmluvného záväzku bude naša zodpovednosť obmedzená na predvídateľnú škodu typickú pre zmluvu, pokiaľ nie je v predchádzajúcom ustanovení (1) uvedená neobmedzená zodpovednosť. Podstatné zmluvné záväzky sú také záväzky, ktorých plnenie je nevyhnutné pre riadne plnenie zmluvy a na ktorých plnenie sa vy ako náš zmluvný partner môžete pravidelne spoliehať.
(3) V opačnom prípade je naša zodpovednosť vylúčená.
(4) Vyššie uvedené obmedzenie zodpovednosti sa vzťahuje aj na akúkoľvek zodpovednosť našich zamestnancov, personál, vedúcich pracovníkov, zastupujúcich zástupcov a právnych zástupcov.
V. Rôzne ustanovenia
1. Platné právne predpisy a miestna príslušnosť
Náš zmluvný vzťah sa riadi a vykladá v súlade s právnymi predpismi Spolkovej republiky Nemecko s výnimkou Dohovoru OSN o zmluvách o medzinárodnej kúpe tovaru (CISG). Povinné ustanovenia štátu, v ktorom máte ako spotrebiteľ obvyklý pobyt, však zostávajú nedotknuté.
2. Miesto plnenia
Pokiaľ nie je výslovne dohodnuté inak alebo stanovené inak záväznými ustanoveniami o ochrane spotrebiteľov, miestom plnenia bude miesto nášho sídla uvedené v kapitole I.

II. Scope and Definitions
(1) These General Terms and Conditions shall apply to all product orders by you via the https://shop.cybex-online.com/ website and to all other legal transactions entered into between you and us, CYBEX Retail GmbH, by using this website, which will be referred to as “CYBEX Online Shop” hereinbelow.
(2) Our CYBEX Online Shop is directed exclusively to consumers.
(3) By placing an order in our CYBEX Online Shop, you acknowledge and agree that you are of legal age as required in your country to enter into binding contracts.
III. Conclusion of the Purchase Contract
1. Ordering and steps to conclude the contract
(1) The products displayed in the CYBEX Online Shop do not yet constitute a binding offer by us to enter into a purchase contract. It is only an invitation to you to submit a binding purchase offer.
(2) Prior to placing the first order, you may register as a new customer. You may also register at a later date. Placing an order is also possible without registration, i.e., as a guest.
The mandatory data requested in the course of the registration or ordering process must be provided truthfully. Where you provide additional voluntary information, any such information must also be truthful.
(3) Activating the “Add to Cart” button allows you to put the desired goods into the virtual shopping cart without obligation. We may refuse a refund until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event not later than within fourteen days from the day you have notified us of the revocation of this contract:

The deadline is considered observed if you dispatch the goods prior to the end of the fourteen-day period.
If the returned goods are shipped within the Federal Republic of Germany, the costs of returning the goods will be borne by us. In all other events, the direct costs of returning the goods will have to be borne by you. View our table of costs for reference.
You will only be liable for any loss of value of the goods if such loss of value is due to handling of the goods which is not necessary for testing the nature, properties and functioning of the goods.

(2) Exclusion of the right of revocation:
A right of revocation does not exist for the following contracts, unless the parties have agreed otherwise:
- contracts for the supply of goods which are not prefabricated and the production of which is governed by an individual selection or determination by the consumer or which are clearly tailored to the consumer’s individual needs;
- contracts for the delivery of sealed goods that are not suitable for return on grounds of health protection or hygiene if their seal has been removed after delivery.

4. Additional voluntary right of return

Within this 30-day period, you may cancel the contract (even after the 14-day revocation period) by returning the goods to us. This does not apply to goods that are also excluded from the statutory right of revocation.
To exercise your right of return, it is required that the goods are complete, in their original packaging and in an unused and undamaged condition. No seals on the goods may be damaged or removed. The deadline is considered observed if you dispatch the goods in time.

If you return goods in accordance with such voluntarily granted right of return, we will reimburse you for the purchase price paid after receiving the goods. If the returned goods are shipped within the Federal Republic of Germany, the costs of returning the goods will also be borne by us.
(2) Your statutory right of revocation and your other legal rights will remain unaffected by such voluntarily granted right of return.
5. Additional information
(1) We are storing the contractual text of the orders, which may be accessed by you after completion of the ordering process. You may also print out your order information upon sending your order. Upon our acknowledgment of receipt, but no later than upon delivery of the goods, we will also provide you with the contents of the contract in text form (email or hard copy).
(2) These Terms and Conditions may be viewed, saved and printed out at any time on our CYBEX Online Shop website under the hyperlink “Terms and Conditions”.
(3) The contract will be concluded and performed in English and Slovak.
IV. Performance of the Purchase Contract; Payment Processing; Delivery
1. Prices and shipping costs; Special offers; Availability; Delivery restrictions
(1) Our prices include statutory value-added tax as applicable at the time of your order.
(2) We charge a flat rate for shipping. The rate for standard shipping within Germany is EUR 7.90. For any other EU Member States to which we deliver, a flat-rate shipping charge of EUR 9.90 applies.
The shipping costs will be clearly communicated to you again at least on the product detail page (where applicable, via a hyperlink).
(3) Please note that we are usually only able to feature special offers within a limited period of time. The goods displayed in the CYBEX Online Shop are also subject to different availability. The availability of a product may also vary depending on your specifications (such as size or colour). If a product is unavailable, this will be indicated at the respective product information.
If it turns out upon receipt of your order that the goods ordered from us are temporarily unavailable, we will notify you in the acknowledgment of receipt without undue delay or contact you (e.g., by additional email). If the goods are permanently out of stock, we will be unable to accept your order so that in such event, no contract will come into existence.
2. Payment methods and terms of payment; Scoring
(1) Payment for the goods is to be made by one of the payment methods listed below. We shall be entitled, however, to exclude certain payment methods in individual cases.
Credit card: When paying by credit card, the amount will be debited when the goods are shipped. We accept American Express, VISA, and Mastercard.
PayPal: You will need a PayPal account to pay with the PayPal online payment service. If you select this payment method, you will be redirected to the PayPal website for payment. The amount will be debited upon shipment of the goods.
Apple Pay: Apple Pay is a payment method offered by Apple Inc. To use Apple Pay, you must activate the Apple Pay function (e.g., on your iPhone), identify yourself with your access data and confirm the payment order. The amount will be debited upon shipment of the goods.
Gift voucher: Gift vouchers and the relevant credit balances associated with them may only be redeemed before the order process is completed. Any use after completion of the order process is not possible. The credit balance of a gift voucher will neither be paid out in cash nor does it bear interest.
(2) Irrespective of the selected payment method, you will receive an invoice at the latest together with delivery of the goods. If the invoice address differs from the delivery address, we will send the invoice by post to the invoice address or by e-mail to the e-mail address provided to us by you.
3. Delivery times; Shipping and transfer of risk; Partial deliveries; Default
(1) The delivery times listed in the table in the CYBEX Online Shop apply to deliveries within Germany and are understood to be starting with our binding acceptance of your purchase offer.
Information on delivery times for deliveries to other countries are also listed in the table.
(2) Deliveries will be made to the delivery address specified by you. Shipments will be carried out by a suitable transport company. The risk of accidental loss of the ordered goods shall pass to you as soon as the goods have been handed over to you or your authorized representative or if you are in default of acceptance.
(3) We shall be entitled to make partial deliveries, provided such are reasonable for you. Where partial deliveries are made, any additional shipping costs shall be borne by us.
(4) If you are in arrears with payment, we reserve the right to claim the statutory default interest from you. The assertion of additional damages caused by default shall remain reserved.
4. Retention of title; Offsetting and retention
(1) The goods shall remain our property until the invoice amount has been paid in full.
(2) You may only set off claims against our claims with counterclaims that have been legally established or are undisputed.
(3) Rights of retention are only permitted where they relate to claims based on the same contractual relationship.
5. Your rights relating to defects
If goods are damaged or if they exhibit another defect (e.g., the delivery is incomplete), you shall be entitled to the statutory rights under German law against us for defects (“warranty rights”) together with any other protections under mandatory provisions in the State in which you as a consumer have your habitual residence.
6. Liability and limitation of liability
(1) We shall be liable to you without limitation in the event of intent (including fraudulent intent) or gross negligence, in the event of negligent or intentional injury to life, body or health, on the basis of a guarantee promise (unless stipulated otherwise) and on the basis of mandatory liability such as under the German Product Liability Act together the Product Liability Act under mandatory provisions in the State in which you as a consumer have your habitual residence.
(2) In the event of a breach of a material contractual obligation, our liability shall be limited to the foreseeable damage typical for the contract, unless unlimited liability is provided for in foregoing clause (1). Material contractual obligations are such obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance you, as our contractual partner, may regularly rely.
(3) Otherwise, our liability is excluded.
(4) The foregoing limitation of liability shall also apply with respect to any liability of our employees, staff, executives, vicarious agents and legal representatives.
V. Miscellaneous Provisions
1. Applicable law and legal venue
Our contractual relationship shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the State in which you as a consumer have your habitual residence shall, however, remain unaffected.
2. Place of performance
Unless expressly agreed otherwise or stipulate otherwise by mandatory provisions for the protection of consumers, the place of performance shall be the place of our registered office listed in Chapter I.
3. Information under the German Act on Alternative Dispute Resolution in Consumer Matters
There is no obligation or willingness to participate in dispute resolution proceedings before a consumer arbitration board.
